1. Acceptance of Terms
By accessing or using the OneOral website, mobile application, or any services offered by OneOral LLC ("OneOral," "we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and members.
2. Description of Services
OneOral provides personalized oral health memberships, including quarterly kit shipments, virtual dental consultations, nutrition plans, and access to the OneOral app. Our services are intended for adults 18 years of age or older residing in the United States. OneOral is not a licensed dental practice and does not provide emergency dental care.
3. Membership and Billing
By enrolling in a OneOral membership, you authorize us to charge your payment method on a recurring monthly basis at the then-current membership rate. Your membership automatically renews each month until cancelled. You may cancel at any time through the member portal. Charges are non-refundable except as required by applicable law or as described in our refund policy. Prices are subject to change with 30 days' notice.
4. Telehealth and Virtual Dental Services
Virtual dental consultations available through OneOral are provided by independently licensed dental professionals. OneOral facilitates access to these services but is not responsible for the clinical judgment or recommendations of any dental professional. Telehealth services are not a substitute for in-person emergency dental care. You should contact a local emergency provider or call 911 in the event of a dental emergency.
5. Prescription Products
Certain products in your OneOral kit may require a prescription issued by a licensed dental professional. By using our services, you consent to a telehealth evaluation for the purpose of determining your eligibility for prescription oral care products. Prescription products will only be dispensed if clinically appropriate. OneOral does not guarantee that a prescription will be issued for any specific product.
6. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. OneOral reserves the right to suspend or terminate accounts that violate these terms or that we believe pose a security risk.
7. Intellectual Property
All content on the OneOral platform — including text, images, graphics, logos, software, and product formulations — is the property of OneOral LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
8. Prohibited Conduct
You agree not to: (a) use our services for any unlawful purpose; (b) attempt to gain unauthorized access to our systems; (c) interfere with the operation of our platform; (d) resell or redistribute our products or services without authorization; (e) submit false or misleading health information; or (f) engage in any conduct that damages, disables, or impairs our services.
9. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, express or implied. OneOral does not warrant that our services will be uninterrupted, error-free, or free of harmful components. Results from our oral health products vary by individual and are not guaranteed.
10. Limitation of Liability
To the fullest extent permitted by law, OneOral shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability to you for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.
11. Governing Law
These Terms of Use are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
12. Changes to These Terms
We may update these Terms of Use from time to time. We will notify you of material changes by email or by posting a notice on our platform. Your continued use of our services after any changes constitutes acceptance of the updated terms.
